1. Object

The French Chamber of Commerce and Industry in Georgia (after named the Chamber of Commerce), is editing the site www.ccifg.ge (after designated as the "Site").

The access to the Site and to its services are submitted to the acceptance without reserve and to the respect of the following general utilisation conditions that can be completed by particular utilisation conditions for some services, for exemple the utilisation conditions of Facebook and Linkedin available at http://www.facebook.com/terms.php et https://www.linkedin.com/legal/privacy-policy?_l=fr_FR.

The Chamber of Commerce reserves the right to modify and update everything or some parts of the following general conditions, without notice and without the need to inform beforehand the users.

These modifications and updates are imposed on the users, not engaging the responsability of the Chamber of Commerce. The user must in consequence refer regulary to this column to check the current general utilisation conditions.

 

2. Confidentiality policy (personal date, cookies)

The Site's confidentiality policy (see "Confidentiality policy") determines the personal information that the users accept to communicate to the Chamber of Commerce on the Site as well as the utilisation conditions of "coookies" by the Chamber of Commerce at the occasion of a navigation on the Site. 

The Chamber of Commerce can modify its Confidentiality Policy at every moment. 

The Chamber of Commerce is likely to collect personal date on the users. These data are for the exclusive use of the Chamber of Commerce. Your personal data are confidential and preserved and exploited by the Chamber of Commerce and the members of its network. 

In conformity with the law on "Data Protection Act" of January 6th, 1978 and updated in 2004, the user have the right to access, to rectify and to remove its personal data as well as have the right to make opposition for his/her data not to be treated by contacting us to the following address:  info@ccifg.ge.

The Chamber of Commerce reserves the right to possibly ask to the user to send a photocopy of an ID document with signature in order to justify his/her identity. 

In the hypothesis that the user accepts, through forms, to receive by mail information, he can at any time come back on his/her decision by sending a mail with the object "unsubscription" to the following address: info@ccifg.ge

The information data bases likely to be gathered on the Site are protected. Every extraction or attempt to extract, total or partial, may engage the civil or penal responsability of the offender. 

 

3. Intelectual property

The Chamber of Commerce is the owner of or licensee of intellectual property rights of the Site, the services proposed and on every elements making its composition and allows a limited licence for access and use, but only for a personal use. The granted rights do not give to the user the right to modify, sell, under-licenced or transfer the corresponding rights. 

The brands, logo linked to the Chamber of Commerce, deposed or not, displayed on the Site, as well as its domain name http://www.ccifg.ge are and remain the exclusively ownership of the Chamber of Commerce. Any reproduction, distribution, transmission, modification or use of the brands without the express consent and beforehand of the Chamber of Commerce, for any motive, is forbidden. 

The user may do a copy of the Internet pages published on the Site for his/her private, personal and non commercial use, providing that the Internet pages' copy conserve every notice relating to author rights and to exclusive rights that are featured. 

If the user wish to create a hyperlink to the Site, the user must take contact with the person in charge of the site in order to get her concent. 

The Chamber of Commerce can not be accounted responsible for the sites'content that are subjected to hyperlink to its Site.  

 

4.Responsability

4.1 Chamber of Commerce's responsability

The Chamber of Commerce can not guaranty that no functional mistake or malfunction will not appear during the Site's utilisation and with the proposed services and that it is exempt from mistakes or default. Thus the responsability of the Chamber of Commerce can not be engaged. 

Taking into account the inherent hazard characteristics of Internet, and despite the effort put in place during the development of the Site, the Chamber of Commerce can not be accounted responsible for the Site's misappropriation or hacking. 

The Chamber of Commerce will not be accounted responsible for elements outside of its control and of the damages that could eventually be suffered by your technical environment. 

The Chamber of Commerce will not be accounted responsible towards you or a third person of any indirect damage, incident, special or accessory - that includes, without being exhaustive, any loss of profits, or any other indirect loss - resulting of your utilisation of the Site or incapacity to use it. This apparent limitation of responsability applies in the limit authorised by the law. 

The Chamber of Commerce reserves the right, at any moment at its entire discretion and with or without notice, to correct, modify, remove the Site's content and services proposed without engaging its responsability. 

The Site is by principle accessible 24/24h, 7/7d.

The Chamber of Commerce and the web host will make the best efforts to insure to the users an access to the Site, without however being subject to any obligation to achieve this.  They are able, at any time, especially for technical reasons, for updates, or for maintenance, to interrupt the access to the Site and to the different services that it contains.

4.2 Users'responsability

The use of the Site and of its proposed services is done under the exclusive responsability of the user. The user engages hiself/herself to use the Site and the proposed services in conformity with the general conditions of utilisation as well as the legal dispositions and reglemantations in force, respecting public order and decency. 

Especially the user engages hiself/herself: 

  • to communicate only correct and up to date information ;
  • to not communicate information to the Chamber of Commerce that could harm the rights of a third persone (espacially the use in the mail address or in the  pseudonym, of the name, brand or elements of protected pieces of others protected by the right on intelectual property,...) or against the public order. 

The Chamber of Commerce can not be accounted responsible for the consequences of a fraudulent use by a third person. 

In a general way, the user engage hiself/herself to compensate the Chamber of Commerce of any eventual damageable consequences linked directly or indirectly to prosecutions engaged by a third party against the Chamber of Commerce linked to the non observance by the user of one of the mentionned general conditions and to pay all the lawyer fees, expertises and other fees unrecoverable and other expenses that would result of such an action.

 

5.Severability

The illegality, invalidity or the non application of any of the mentionned general conditions of obligations will not affect the legality, validity or the enforceable nature of the other stipulations.

 

6.Applicable law – Litigations

The present conditions and terms are under French law. The language of the present conditions is the French language. 

In case of reclamations or litigations, the parties will attempt to find a friendly solution before starting any justice actions, and will not interrupt the statutory to act.

If no friendly solution fixed by the present article is found, the contestations that could arise from the validity, interpretation or execution of the present notice or from a consequence, will be heard solely by the Paris courts if the user is a retailer or by default under the juridiction of the place where the user lives.
